Privacy Policy

This document explains how MORFIKA uses your data: what data is collected, to what extent, for what purpose and on what legal basis. It also informs you how your personal data is protected and what rights you have in connection with the processing of your data.

In this Privacy Policy, we refer to you as the “User” – a person who uses the website morfika.nowykolektyw.com (hereinafter: the “Website”).

GENERAL CONDITIONS

The administrator of personal data collected via the Website: morfika.nowykolektyw.com is Agata Nowak, running a business under the name SELKIE Agata Nowak with its registered office in Gliwice (44-100), ul. Plebiscytowa 6a/12 NIP: PL6312368411, hereinafter referred to as the “Administrator”, which is also the owner of this website.

The administrator has not appointed a Data Protection Inspector. Personal data are processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (referred to as “GDPR”, “GDPR”, “GDPR” or “General Data Protection Regulation”). LAWFUL AND FAIR PROCESSING OF PERSONAL DATA

The data collected by the Administrator will be:

  • processed in accordance with the law,
  • processed for clearly defined purposes and not subjected to further processing that is incompatible with those purposes
  • accurate and adequate in relation to the purposes for which they are processed, stored for no longer than necessary to achieve the purposes of processing.

PURPOSE AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

The Administrator processes personal data necessary to provide and develop services offered via the Website and its individual functionalities.

The processing of personal data will have the following purposes:

  • communication with the User in order to provide him with the necessary information and establish a positive and reliable relationship with him, which constitutes the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR);
  • promoting the Administrator’s and its partners’ own products and/or services by sending marketing messages by e-mail, provided that the User has consented to receiving such messages by e-mail (Article 6(1)(a) of the GDPR);
  • for analytical and statistical purposes based on the legitimate interest of the Administrator consisting in verifying the activity and preferences of users in order to optimize the services and products and functionalities of the Website (Article 6(1)(f) of the GDPR);
  • possible determination, pursuit or defense of claims based on the Administrator’s legitimate interest in protecting its rights (Article 6(1)(f) of the GDPR).

WHAT PERSONAL DATA IS PROCESSED?

  1. The user may contact MORFIKA via e-mail. By sending an e-mail, the User provides the Administrator with his or her personal data, which will be saved.
  2. The provided data will be used only to process the inquiry (including providing answers and possible explanations).
  3. This data will be deleted at the latest when it is no longer necessary to achieve the purpose of the conversation and the subject of the contact has been clarified.
  4. The user may withdraw consent to the processing of personal data at any time. The User may do this by informing the Administrator about the withdrawal of consent by sending an e-mail to the following address: agata@morfika.pl
  5. In this case, all personal data from the conversation will be deleted and no further conversation will be possible.
  6. When the User uses the Website for information purposes, the Website server downloads data sent by the User’s web browser and stores some of it in log files, such as:
  • type of web browser used
  • operating system and version
  • operating system interface
  • date and time of access to the website
  • websites visited
  • access status/http response code
  • amount of data transferred
  • previously visited page.

This information is not combined or stored with other personal data.

PERSONAL DATA PROCESSING TIME

The User’s personal data will be processed for the time necessary to achieve the purposes for which the data is processed:

  • until the expiry of the limitation period for any claims related to the functioning of the Website, including those arising from contracts concluded via it,
  • until a justified objection is raised in relation to data processed in the legitimate interest of the Administrator,
  • expiry of the legal obligation to store data, including the obligation to store accounting documents relating to concluded contracts.

INFORMATION ON THE PROCESSING OF PERSONAL DATA

Depending on the purpose of processing, personal data may be disclosed

  • entities related to the Administrator
  • entities cooperating with the Administrator
  • entities processing online payments
  • entities providing courier and postal services
  • law firms.

Personal data processed by the Administrator will in some cases be transferred outside the European Economic Area (Google Analytics).

RIGHTS OF DATA SUBJECTS (USERS)

The Website User has the right to:

  • access to your personal data,
  • request rectification (correction) of your personal data,
  • deletion of personal data,
  • restrictions on the processing of personal data,
  • data transfer,
  • object to processing carried out on the basis of the legitimate interest of the controller,
  • withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal,

The user has the right to lodge a complaint with the President of the Personal Data Protection Office if he/she considers that the processing violates his/her rights and freedoms.

Automated decision-making, including profiling, will not be used in data processing.

DATA SECURITY

The Administrator applies appropriate technical security measures to prevent accidental disclosure of the User’s stored personal data to unauthorized persons or intentional access of such persons to personal data.

FINAL PROVISIONS

The Administrator reserves the right to make changes to this Privacy Policy, while ensuring that Users’ rights arising from this document will not be limited.

The User will be informed about any changes to the Privacy Policy via a message available on the Website.
